Botcomms Terms and Conditions of Use

Welcome to Botcomms, the advanced AI-powered WhatsApp and Telegram auto-reply platform. Please read the following terms and conditions carefully before using our services. Your access and use of Botcomms indicates your acceptance of and compliance with these terms. By selecting "I agree," downloading or using the Application, you agree to the terms of this Agreement. If you do not agree, please refrain from clicking "I agree" and refrain from downloading or using the Application.

This legal document governs your relationship with Botcomms regarding the use of the Application provided by Botcomms. Botcomms grants you a license to use, not to own, subject to the terms of this Agreement.


1. Registration and Connection to WhatsApp:

1.1 When using Botcomms, you must register and connect the Application to your WhatsApp business API from Meta account using a QR code provided by us.

1.2 Connection to WhatsApp involves the application of Artificial Intelligence techniques to analyze your conversations and extract relevant information, including, but not limited to, documents and FAQs.

1.3 By connecting Botcomms to your business and/or personal WhatsApp account, you warrant that you have the necessary authority to share the information, acknowledging that the application will perform automated analysis of your conversations.


2. Account Use:

2.1 The ability to register on Botcomms is open to natural and legal persons with the proper legal capacity to contract these services. Therefore, those who lack such capacity, including minors or persons temporarily or permanently disabled on the platform, will not be able to use them.

2.2 Botcomms may unilaterally exclude the registration of users if, at its discretion, the user's conduct is considered harmful or offensive to other users, the platform, its staff or third parties.

2.3 In order to use Botcomms, Users must follow the instructions, provide complete information and update it regularly. Botcomms reserves the right to identify Users and request additional data. It may also reject requests that do not meet the requirements.

2.4 In the event of suspicious information, Botcomms may temporarily or permanently suspend the responsible User, without the right to compensation. Access to the account is granted by means of an email address and password, which is the responsibility of the User. The transfer of the account is prohibited, as is the creation of new registrations after cancellations.

2.5 The User's nickname must not resemble the Botcomms name, and it is not permitted to represent oneself as an employee of the platform. Botcomms may deny registrations and cancel accounts without notice in the event of non-compliance.


3. Risks and Responsibilities:

3.1 As Botcomms is a new platform, there are inherent risks such as the possible loss of phone number or information. You agree to these risks and release Botcomms from any related liability.

3.2 You understand that Botcomms assumes no responsibility for data loss, service interruptions, or any damage resulting from the use of the application.

3.3 You acknowledge and agree that in the event of unusual behavior or spamming through the platform, WhatsApp may suspend the number associated with the service. Botcomms is not associated with WhatsApp and is not a third-party service like META.


4. Plans and Billing:

4.1 Botcomms offers various monthly subscription plans. There are no mandatory terms and you can cancel at any time.

4.2 You agree to pay the fees corresponding to the selected plan, and billing will be done automatically on a monthly basis.

4.3 On Botcomms, the prices shown are associated with each Subscription billing period, automatically renewing at the end of each cycle. The Subscription will continue to renew until the User cancels his/her subscription by requesting termination of services from the Botcomms support team.

4.4 In the event of a cancellation request, the Account will remain on the current plan until the end of the current billing cycle. Any changes to the category or number of linked Users will be applied in the next billing cycle. To make changes or cancel the Subscription, the User must contact the Botcomms support team.


5. Account Cancellation and Suspension:

5.1 Botcomms reserves the right to cancel, suspend or restrict the User's Account and/or Subscription at any time and at its discretion, without prior notice or liability, in the event of non-compliance with obligations or violation of the Terms and Conditions. In situations determined by competent authorities, Botcomms may provide User data and transaction history to assist in investigations.

5.2 By accepting these terms, the User acknowledges that he/she will not receive a refund or compensation for any remaining periods of the Subscription, Content and/or Services not used after cancellation.

5.3 Botcomms reserves the right, at its sole discretion, to suspend User Accounts and to remove or modify, in whole or in part, any content that is deemed harmful, illegal, threatening, discriminatory, defamatory, pornographic, or that violates the law, regulations, or that goes against morality and/or good customs.


6. Manual Upload of Information:

6.1 Although Botcomms automatically analyzes your WhatsApp and Telegram conversations, you have the option to manually upload information to enrich the data extraction.


7. Privacy:

7.1 Botcomms values ​​and respects your privacy. Please see our Privacy Policy for detailed information on how we handle your data.


7.2 GDPR Compliance: Botcomms is committed to ensuring the protection of personal data in accordance with the General Data Protection Regulation (GDPR). We enable our clients to process their customers personal data lawfully, fairly, and transparently. Users have the right to access, rectify, erase, and restrict the processing of their personal data, as well as the right to data portability. 8. Modifications and Updates:

8.1 We reserve the right to modify these terms at any time. Modifications will be effective immediately upon posting on the App.


9. Termination:

9.1 Botcomms reserves the right to terminate your access to the App for any breach of these terms and subject to civil litigation trial.
